Know Your Rights: Title IX in San Diego

What is Title IX?

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal educational assistance…” – TITLE IX, EDUCATION AMENDMENTS OF 1972

Meaning, if you are enrolled at any school (high schools included!) that receives federal funding, you have the federally-protected right to attend school and school-sanctioned events (including sports) without being sexually harassed or discriminated against on the basis of your sex.

Sexual harassment includes (but is not limited to): attempted or completed rape or sexual assault; unwanted pressure for sexual favors or dates; unwanted touching, cornering, or leaning over; unwanted sexual looks or gestures; unwanted letters, telephone calls, or materials of a sexual nature; and unwanted sexual comments, jokes, remarks, or questions.

Who does Title IX protect?

“Title IX protects all students at recipient institutions from sex discrimination, including sexual violence. Any student can experience sexual violence: from elementary to professional school students; male, female, [and gender nonconforming] students; straight, gay, lesbian, bisexual and transgender students; part-time and full-time students; students with and without disabilities; and students of different races and national origins.” Additionally, “Title IX protects all students at recipient institutions in the United States regardless of national origin, immigration status, or citizenship status” (OCR Title IX Resource).  Title IX also protects faculty and staff from any sex-based discrimination, harassment, or violence (KnowYourIX).

When should you contact your Title IX coordinator or Deputy Coordinator?

  • to “seek information or training about students’ rights and courses of action available to resolve reports or complaints that involve potential sex discrimination, including sexual misconduct,
  • to “file a complaint or make a report of sex discrimination, including sexual misconduct,
  • to “notify the College of an incident or policy or procedure that may raise potential Title IX concerns,
  • to “get information about available resources (including confidential resources) and support services relating to sex discrimination, including sexual misconduct, and
  • to “ask questions about the College’s policies and procedures related to sex discrimination, including sexual misconduct.” Notalone.org

To file a Title IX Claim

If your school does not have a Title IX coordinator or your claim has been mishandled, you have the right to file a complaint with the Office for Civil Rights with the US Department of Education.
